Actually 35 % of the population account for 6-18 years of age (school going children) in India, which is equivalent to 45.5 crores (out of 130 crores expected in 2016). Out of which 8.4 crores children don’t go to school. That means about 19% of children don’t go to school at all. This is huge and really alarming !

Nayak: I met former IAS Harish Gowda last evening. Had one hour of discussion. He  said- the best way to develop govt school or hospitals is to decentralize the governance. This is the only way to decrease corruption and privatization, he said.

Yogish: Now the school governance is within the SDMC and I believe they can take the decision for the school with the fund allocated to them

I thought giving power to SDMC is one of them

Nayak: This is delegation and not decentralization.

Yogish: Who do we expect as part of the decentralization ?

Nayak: Grama Sabhas (or Zilla Panchayath) owning the school including fund generation (majority of the funds), decision making and execution.

Yogish: Let’s list out requirements to decentralize

Hemanth Sharma: I believe dr Sandeep mean a community school and power for running the school given to Panchayat for example

Nayak: Almost County system of education. However, the system in US is dismantled because except school, all other services are corporate driven.

Finland is the best examples.

Yogish: Mainly funding is required to run school. Are you expecting gram panchayath to generate that fund. And also are you expecting gram panchayath should have a power to appoint teachers and execute any development activities ?. Are you expecting each school to be autonomous ?

Nayak: Not Grama Panchayath at this point. Capacity generation In Grama Panchayath may be extremely tough at this point. However, district units can be made autonomous.We can argue on numbers but this is my suggestion.

70% funds should be generated locally.

20% of fund from state

10% of fund from center

However, local bodies should compete with one another to get state and center funds.

Hemanth Sharma: Full autonomy is a problem… autonomy within some restrictions. Even at district level funding will be problem so that need to be arranged to some extent by state / center some district too are extremely poor we would not like the children to suffer in those district

Mudigere: The above could be for future. lets focus with current situation how we can improve school s similar to Haaradi and beyond

Nayak: I agree. Autonomy in service delivery is needed. Policy matters can be taken up by state or center.

Nayak: That’s because a legislator has much power with him/her beyond his primary job of legislation making.We can try. But high likely to be not sustainability model.

Yogish: We need to come up with numbers to propose a decentralization plan. There is no transparency regarding the allocation and utilization of education fund (after deducting teacher’s salary, training and other things) to each school or to each school.

Nayak: Decentralization will empower citizens (through local bodies) and take away power of state (or MLA).That’s good way forward, Yogish sir.

ಹೈಕೋರ್ಟ್‌ಗೆ ಸಾರ್ವಜನಿಕ ಶಿಕ್ಷಣ ಇಲಾಖೆ ಆಯುಕ್ತರ ಪ್ರಮಾಣಪತ್ರ ಬೆಂಗಳೂರು: ಇನ್ನು ಖಾಸಗಿ ಅನುದಾನರಹಿತ ಶಾಲೆಗಳು ಮನಬಂದಂತೆ ಶುಲ್ಕ ವಿಧಿಸುವಂತಿಲ್ಲ. ಶುಲ್ಕ ನಿಗದಿಗೆ ಸಂಬಂಧಿಸಿದಂತೆ ಕರ್ನಾಟಕ ಶಿಕ್ಷಣ ಕಾಯಿದೆ ಅಡಿ ಸಾರ್ವಜನಿಕ ಶಿಕ್ಷಣ ಇಲಾಖೆ ಹೊಸ ಕರಡು ನಿಯಮಗಳನ್ನು ರೂಪಿಸಿದೆ.

ಸಧ್ಯದಲ್ಲೇ ಆ ಕರಡು ನಿಯಮಗಳನ್ನು ರಾಜ್ಯಪತ್ರದಲ್ಲಿ ಪ್ರಕಟಿಸಿ, ಅವುಗಳಿಗೆ ಸಾರ್ವಜನಿಕರು, ತಜ್ಞರು ಹಾಗೂ ಶಿಕ್ಷಣ ಸಂಸ್ಥೆಗಳಿಂದ ಆಕ್ಷೇಪಣೆ ಆಹ್ವಾನಿಸಲಾಗುವುದು. ಆನಂತರ ಅವುಗಳನ್ನು ಪರಿಶೀಲಿಸಿದ ಬಳಿಕ ಹೊಸ ನಿಯಮಗಳನ್ನು ಅಖೈರುಗೊಳಿಸಲಿದೆ. ಶಾಲಾ ಶುಲ್ಕ ನಿಗದಿಗೆ ಸಂಬಂಧಿಸಿದಂತೆ ಹಲವು ಖಾಸಗಿ ಶಾಲೆಗಳು ಸಲ್ಲಿಸಿರುವ ಅರ್ಜಿಗಳನ್ನು ಆಲಿಸುತ್ತಿರುವ ನ್ಯಾ.ಜಯಂತ್‌ ಪಟೇಲ್‌ ನೇತೃತ್ವದ ನ್ಯಾಯಪೀಠದ ಮುಂದೆ ಸಾರ್ವಜನಿಕ ಶಿಕ್ಷಣ ಇಲಾಖೆ ಆಯುಕ್ತರಾದ ಸೌಜನ್ಯ ಅವರು ಸಲ್ಲಿಸಿರುವ ಪ್ರಮಾಣಪತ್ರದಲ್ಲಿ ಈ ವಿಷಯ ತಿಳಿಸಲಾಗಿದೆ. ನ್ಯಾಯಾಲಯಕ್ಕೆ ಕರಡು ನಿಯಮಗಳನ್ನು ಸಲ್ಲಿಸಿರುವ ಅವರು, ನಿಯಮಗಳನ್ನು ಇನ್ನೂ ಕಾನೂನು ಮತ್ತು ಶಿಕ್ಷಣ ಇಲಾಖೆ ಪರಿಶೀಲನೆ ನಡೆಸುತ್ತಿವೆ. ಅವುಗಳನ್ನು ಅಂತಿಮಗೊಳಿಸಲು ಸಮಯಾವಕಾಶ ಬೇಕಾಗಿದೆ ಎಂದು ನ್ಯಾಯಪೀಠವನ್ನು ಕೋರಿದ್ದಾರೆ. ನ್ಯಾಯಪೀಠ ವಿಚಾರಣೆಯನ್ನು ಆ.5ಕ್ಕೆ ಮುಂದೂಡಿ, ಅಷ್ಟರೊಳಗೆ ಕರಡು ನಿಯಮಗಳ ಅಧಿಸೂಚನೆ ಹೊರಡಿಸಿ ಎಂದು ಸರಕಾರಕ್ಕೆ ಸೂಚನೆ ನೀಡಿತು.

”ಕರ್ನಾಟಕ ಶಿಕ್ಷಣ ಕಾಯಿದೆ ಅಡಿ ಬರುವ ಕರ್ನಾಟಕ ಶಿಕ್ಷಣ ಸಂಸ್ಥೆಗಳ (ವರ್ಗೀಕರಣ, ನಿಯಂತ್ರಣ ಮತ್ತು ಪಠ್ಯಕ್ರಮ) ನಿಯಮ 1995 ಮತ್ತು ಕರ್ನಾಟಕ ಶಿಕ್ಷಣ ಸಂಸ್ಥೆಗಳ (ಕೆಲವು ಶುಲ್ಕಗಳು ಮತ್ತು ದೇಣಿಗೆ) ನಿಯಂತ್ರಣ ನಿಯಮ 1999ರನ್ನು ತಿದ್ದುಪಡಿ ಮಾಡಿ, ಶುಲ್ಕ ನಿಯಂತ್ರಣಕ್ಕೆ ಸಂಬಂಧಿಸಿದಂತೆ ಸಮಗ್ರ ನಿಯಮ ಒಳಗೊಂಡ ಕರಡು ಸಿದ್ದಪಡಿಸಲಾಗಿದೆ. ರಾಜ್ಯಪತ್ರದಲ್ಲಿ ಪ್ರಕಟಿಸಿ, ಸಾರ್ವಜನಿಕರ ಆಕ್ಷೇಪಣೆಗೆ 15 ದಿನ ಕಾಲಾವಕಾಶ ನೀಡಲಾಗುವುದು” ಎಂದು ಸೌಜನ್ಯ ಅವರು ಪ್ರಮಾಣಪತ್ರದಲ್ಲಿ ಹೇಳಿದ್ದಾರೆ. ಆಕ್ಷೇಪಣೆ ಸ್ವೀಕರಿಸಿದ ನಂತರ 90 ದಿನಗಳೊಳಗೆ ಅವುಗಳನ್ನು ಪರಿಶೀಲಿಸಿ ನಿಯಮಗಳನ್ನು ಅಖೈರುಗೊಳಿಸಲಾಗುವುದು.ಆ ನಿಯಮಗಳನ್ನು ಕರ್ನಾಟಕ ಶಿಕ್ಷಣ ಸಂಸ್ಥೆಗಳ ನಿಯಂತ್ರಣ ನಿಯಮ 1999ರ ನಿಯಮ 7ರಡಿ ಅಡಕಗೊಳಿಸಲಾಗುವುದು. ಆ ನಿಯಮದಡಿ ಈಗಾಗಲೇ ನಿಗದಿಗಿಂತ ಹೆಚ್ಚಿನ ಶುಲ್ಕ ವಿಧಿಸುವ ಖಾಸಗಿ ಅನುದಾನರಹಿತ ಶಾಲೆಗಳಿಗೆ ಭಾರೀ ದಂಡ ಅಂದರೆ 10ಲಕ್ಷಕ್ಕೂ ಅಧಿಕ ದಂಡ ವಿಧಿಸಬಹುದಾಗಿದೆ ಎಂದು ಅವರು ಪ್ರಮಾಣಪತ್ರದಲ್ಲಿ ತಿಳಿಸಿದ್ದಾರೆ.

ಕರಡು ತಿದ್ದುಪಡಿಯ ಪ್ರಕಾರ, ನಿಯಮ 10(3)(ಬಿ)(ಜಿಜಿ) ಶಿಕ್ಷಣ ಸಂಸ್ಥೆ ಭೌಗೊಳಿಕವಾಗಿ ಯಾವ ಸ್ಥಳದಲ್ಲಿದೆ ಎಂಬುದನ್ನು ಆಧರಿಸಿ ಶಾಲೆಗಳು ತಮ್ಮ ಸಿಬ್ಬಂದಿಯ ವೇತನ ಮತ್ತು ಖರ್ಚು ವೆಚ್ಚಗಳ ಆಧಾರದ ಮೇಲೆ ಶುಲ್ಕವನ್ನು ಸಂಗ್ರಹಿಸಬಹುದಾಗಿದೆ. ಅಂದರೆ, ಗ್ರಾಮ ಪಂಚಾಯ್ತಿ/ತಾಲೂಕು ಪಂಚಾಯ್ತಿ ಅಥವಾ ನಗರಸಭೆಗಳ ಮಟ್ಟದಲ್ಲಾದರೆ, ಶಾಲೆಗಳು ತಮಗೆ ತಗುಲುವ ಖರ್ಚುವೆಚ್ಚದ ಶೇ.50ರಷ್ಟು ಅಧಿಕ, ಸಿಎಂಸಿ ವ್ಯಾಪ್ತಿಯಲ್ಲಿದಾರೆ ಶೇ.60ರಷ್ಟು, ನಗರಪಾಲಿಕೆಗಳ ವ್ಯಾಪ್ತಿಯಲ್ಲಾದರೆ ಶೇ.75ರಷ್ಟು ಮತ್ತು ಬಿಬಿಎಂಪಿ ವ್ಯಾಪ್ತಿಯಲ್ಲಾದರೆ ಶೇ.100ರಷ್ಟು ಅಧಿಕ ಶುಲ್ಕ ಸಂಗ್ರಹಿಸಬಹುದು. ಇದಲ್ಲದೆ, ಕರಡು ತಿದ್ದುಪಡಿ ನಿಯಮ 10(3)(ಸಿ))(ಜಿಜಿ) ಪ್ರಕಾರ ವಿಶೇಷ ಅಭಿವೃದ್ಧಿ ಶುಲ್ಕ ಹಾಲಿ 600ರೂ, ಇದೆ. ಅದನ್ನು 2500ರೂ,ಗೆ ಹೆಚ್ಚಿಸುವ ಪ್ರಸ್ತಾಪವಿದೆ.

ಸೆಕ್ಷನ್‌ 6ರಡಿ ಅರ್ಜಿ ಶುಲ್ಕವನ್ನೂ ಸಹ 50ರೂ.ಗಳಿಗೆ ಹೆಚ್ಚಿಸಲು ಅವಕಾಶ ನೀಡಲಾಗಿದೆ. ಸರಕಾರದಿಂದ (ಆಂಗ್ಲ ಮಾಧ್ಯಮ)ಕ್ಕೆ ಮಾನ್ಯತೆ ಪಡೆದ ಕರ್ನಾಟಕ ಪ್ರಾಥಮಿಕ ಮತ್ತು ಪ್ರೌಢಶಿಕ್ಷಣ ಸಂಸ್ಥೆಗಳ ಆಡಳಿತ ಮಂಡಳಿಗಳ ಒಕ್ಕೂಟ ಹಾಗೂ ಮತ್ತಿತರ ಹತ್ತಾರು ಸಂಸ್ಥೆಗಳು ನ್ಯಾಯಾಲಯದ ಮೊರೆ ಹೋಗಿವೆ. 1995ರಲ್ಲಿ ಖಾಸಗಿ ಶಿಕ್ಷಣ ಸಂಸ್ಥೆಗಳು, ಕರ್ನಾಟಕ ಶಿಕ್ಷಣ ಕಾಯ್ದೆ 1983 ಅನ್ವಯ, ಅದರಲ್ಲೂ ವಿಶೇಷವಾಗಿ ಸೆಕ್ಷನ್‌ (3)(2)ಎ ನಿಂದ ಕೆ ವರೆಗೆ ಇರುವ ಹಲವು ಸೆಕ್ಷನ್‌ಗಳಲ್ಲಿ ಉಲ್ಲೇಖಿಸಲಾಗಿರುವ ಅಂಶಗಳನ್ನು ನ್ಯಾಯಾಲಯದಲ್ಲಿ ಪ್ರಶ್ನಿಸಿದ್ದವು.ಹೈಕೋರ್ಟ್‌ ಆ ಅರ್ಜಿಗಳನ್ನು 1996ರ ಅ.11ರಂದು ವಜಾಗೊಳಿಸಿತ್ತು. ಆ ತೀರ್ಪುನ್ನು ಪ್ರಶ್ನಿಸಿ ಶಿಕ್ಷಣ ಸಂಸ್ಥೆಗಳು ಸುಪ್ರೀಂಕೋರ್ಟ್‌ ಮೆಟ್ಟಿಲೇರಿದ್ದವು.

ಟಿ.ಎಂ.ಎ ಪೈ ಫೌಂಡೇಷನ್‌ ಪ್ರಕರಣದಲ್ಲಿ ನೀಡಿರುವ ತೀರ್ಪಿನ ಅನ್ವಯ ಸುಪ್ರೀಂಕೋರ್ಟ್‌, 2010ರ ಫೆ.11ರಂದು ಪ್ರಕರಣವನ್ನು ಕರ್ನಾಟಕ ಹೈಕೋರ್ಟ್‌ಗೆ ವರ್ಗಾಯಿಸಿ ಅದೇ ಕೋರ್ಟ್‌ ಮರು ಪರಿಶೀಲನೆ ಮಾಡಬೇಕು ಎಂದು ಆದೇಶ ನೀಡಿತ್ತು. ಆ ಹಿನ್ನೆಲೆಯಲ್ಲಿ ಹೈಕೋರ್ಟ್‌ನ ವಿಭಾಗೀಯ ಪೀಠ ವಿಚಾರಣೆ ಕೈಗೆತ್ತಿಕೊಂಡಿದೆ.

Kollegala Sharma: I agree. Right now whether it is raising/ utilization of funds, academic improvement, maintenance etc all. are affected by centralization. Implementation can depend on the whims of a single official. Decentralisation can definitely help. But standardisatiin jn academics have to be kept in mind. One positive I fund in this is that neighbouring Panchayats may compete to better their schools.

Nayak: Yes. And healthy competition between panchayaths will itself promote citizen engagement.

Hemanth Sharma: I am using pi in headless mode mean no display keyboard or mouse, using two apps bVNC and juiceSSH for android if someone has tab these tool can be installed from home when wifi and Internet is available

Yogish: Now I can connect to my Pi Kit (which is in my home) and surprise/trick my family at home from office

Hemanth Sharma: That was my experience too ip too was changing…tool really helps. Do you have static IP. Otherwise it is difficult

This tool work only when pi and phone are connected to same wifi
